联合体投标协议书

立约方： （下简称甲方） （下简称乙方）

甲乙双方自愿组成联合体，以一个投标人的身份共同参

加 项目的投标。双方在平等互利的基础上，就本项目的投标和合同实施阶段的有关事务协商一致，订立如下协议，共同遵守执行：

1. 甲 方作为联合体的牵头单位指定 为牵头人，授权其代表联合体双方负责投标和合同实施阶段的主办、协调工作。（附双方法定代表人签署的《授权书》）

2.双方均有义务提供足够的资料，以满足招标人对投标资格的要求。

3.参加本项目的投标时，投标保证金由 甲 方负责提交。

4.联合体的投标文件、招标人的招标文件、联合体与招标人签订的合同均对双方具有约束力。

5.如果本联合体中标，甲方将享有和承担完成本项目中 的权利和义务，并获得由此而得到的收益和承担相关的责任；乙方将享有和承担完成本项目中 的权利和义务，并获得由此而得到的收益和承担相关的责任。

6.联合体的一方没有履行自己的义务时，应承担另一方由此而造成的直接损失。

7.因联合体的一方或双方没有履行自己的义务，造成联合体在履

行与招标人的合同时违约或联合体与招标人的合同无法继续履行时，直接责任方应承担相关责任。

8.如果本联合体中标，在与招标人签订承包合同之前，双方应就本项目实施过程的有关问题协商一致后，另行签订补充协议，补充协议与本协议具有同等的约束力。

联 合 投 标 协 议 书

CONSORTIUM AGREEMENT

的招标项目投标有关事宜，经各方充分协商一致，达成如下协议：

fully agree on with respect to the bidding project No and arrive at the following agreement:

一、由 牵头， 、 参加，组成联合体共同进行本招标项目的投标工作。

八. Each member shall not make a bid in this project in one’s own name. The leader shall not be a member of other CONSORTIUMS or solo bid party. If the CONSORTIUM bid becomes abandoned tender due to the problems above, other members of CONSORTIUM can take actions against his breach.

九、未中标，本协议自动废止。

负责投标项目的一切组织、协调工作，并授权投标代理人以联合体的名义
