Regulation on Public Holidays for National Annual Festivals and Memorial Days

(promulgated by the Government Affairs Council, amended for the first time on September 18th, 1999 in accordance with the Decision of the State Council on Amending the Regulation on Public Holidays for National Annual Festivals and Memorial Days, and amended for the second time on December 14th, 2007 in accordance with the Decision of the State Council on Amending the Regulation on Public Holidays for National Annual Festivals and Memorial Days)

Article 1 This Regulation is formulated for the purpose of integrating the national annual festivals and memorial days. Article 2 Festivals having a holiday for all citizens: 1. having a one-day holiday for New Year (January 1st);

2. having a three-day holiday for Spring Festival (The New Year’s Eve of the lunar year, the New Year’s Day of the lunar year and second day of the first month of the lunar year);

3. having a one-day holiday for Tomb-sweeping Festival (the lunar Tomb-sweeping Day);

4. having a one-day holiday for Labor Day ( May 1);

5. having a one-day holiday for Dragon Boat Festival (the Dragon Boat Day of the lunar year);

6. having a one-day holiday for Mid-Autumn Festival (the Mid-Autumn Day of the lunar year); and

7. having a three-day holiday for National Day (October 1, 2, 3).

Article 3 Festivals and memorial days having a holiday for part of citizens:

1. Women’s Festival (March 8): a half-day holiday for all women;

第一条 为统一全国年节及纪念日的假期，制定本办法。

第二条 全体公民放假的节日： （一）新年，放假1天（1月1日）； （二）春节，放假3天（农历除夕、正月初一、初二）；

（三）清明节，放假1天（农历清明当日）；

（四）劳动节，放假1天（5月1日）； （五）端午节，放假1天（农历端午当日）；

（六）中秋节，放假1天（农历中秋当日）；

（七）国庆节，放假3天（10月1日、2日、3日）。

第三条 部分公民放假的节日及纪念日：

（一）妇女节（3月8日），妇女放

2. Youth Festival (May 4): a half-day holiday for youth at or above 14-year-old;

3. Children’s Day (Jun 1): a one-day holiday for teenagers and children under 14-year-old;

4. Memorial Day for the found of the People’s Liberation Army (August 1): a half-day holiday for military personnel in active service.

Article 4 Holidays for Chinese minority nationalities’ festivals shall be determined by the local people’s government of each national minority district in accordance with their respective ethnic customs.

Article 5 No holiday for other festivals and memorial days such as

February 7, 1923 Memorial Day, May 30th Memorial Day, July 7 War of Resistance Against Aggression Memorial Day, the Victory of War of Resistance Against Aggression Memorial Day, September 18 Memorial Day, Teacher’s Festival, Nurse’s Festival, Journalist’s Festival, Tree Planting Festival .

Article 6 Where the festival having a holiday for all citizens happen to be on Saturday or Sunday, a compensatory time off shall be taken on a work day. Where the festival having a holiday for part of citizens happen to be on Saturday or Sunday, there will be no compensatory time off. Article 7 This Regulation shall come into force as of the date of promulgation.

假半天； （二）青年节（5月4日），14周岁以上的青年放假半天； （三）儿童节（6月1日），不满14周岁的少年儿童放假1天； （四）中国人民解放军建军纪念日（8月1日），现役军人放假半天。 第四条 少数民族习惯的节日，由各少数民族聚居地区的地方人民政府，按照各该民族习惯，规定放假日期。 第五条 二七纪念日、五卅纪念日、七七抗战纪念日、九三抗战胜利纪念日、九一八纪念日、教师节、护士节、记者节、植树节等其他节日、纪念日，均不放假。 第六条 全体公民放假的假日，如果适逢星期六、星期日，应当在工作日补假。部分公民放假的假日，如果适逢星期六、星期日，则不补假。 第七条 本办法自公布之日起施行。

《国务院关于修改〈全国年节及纪念日放假办法〉的决定》已经20xx年12月7日国务院第198次常务会议通过，现予公布，自20xx年1月1日起施行。
