《十字架上的正义》读后感

当第一次看到施鹏鹏教授所著的《十字架上的正义》这个书名时,我就完全被吸引住了,它促使我思考:十字架是耶稣受难的标记,那它与正义有何关系?带着这个疑惑,我迫不及待地阅读了本书的内容。当读到书中第一篇同名文章时,我豁然开朗:原来,当耶稣被钉于十字架上时,他为人类的罪孽进行了救赎。“神设立耶稣作挽回祭,是凭著耶稣的血,藉著人的信,要显明神的义。因为他用忍耐的心,宽容人先时所犯的罪,好在今时显明他的义,使人知道他自己为义,也称信耶稣的人为义。”十字架由此成了上帝对信仰者的召唤、成为基督正义的源泉。作者阐释了《圣经》中的诉讼和证据法则,这些诉讼及证据法则影响了中世纪及之后的刑事诉讼及证据制度。

这本书思想性与趣味性并存。既提出了一些极为深邃的命题,如正义的意涵、整体性危机、游戏规则与社会秩序建构等,也融合了当下极为新潮有趣的素材,如《哈利·波特》《死亡笔记》等。有些文章则是完全趣味性的,有些文章是历史上的悬案、影视剧体裁以及文学中的诉讼等,如《#9@k牌中的法律故事》《游戏与诉讼》《法律人的爱情之辩》《乔峰的“原罪”与“本罪”》等。

这本书又具有极强的可读性,书中的体裁(神话、寓言、小说、艺术等)貌似与司法诉讼相差甚远,作者却能娓娓道来,在诉讼“内”与“外”游刃有余,通过鲜活的故事,解

构深奥的程序法理,这不能不说是匠心独具,也反映了作者较为扎实的专业功底以及超强的文字驾驭能力。例如同名文章《十字架上的正义》阐释了《圣经》中的诉讼和证据法则,这些诉讼及证据法则影响了中世纪及之后的刑事诉讼及证据制度。书中还收录了作者的大学演讲以及自身的求学经历,字里行间彰显了一位激情四射的青年学者与法学教师。正如作者在书中所写,以最理想的信念、最渊博的知识、最诚挚的态度去对待学术。

《十字架上的正义》虽以宗教与诉讼作为开篇,但作者并未将主题局限于此,而是从诉讼的角度来观察和挖掘文学、历史、神话、艺术、故事中等有趣现象,如《魔法、巫师与神谕裁判的兴起》《冥神抢亲与“调解型诉讼”》《福尔摩斯与柯南:刑事诉讼中的国家与个人》等。

作者在书中所援引的神话、寓言或故事,我们大多听过,有的甚至耳熟能详,但他却能以独特而专业的视角对之进行剖析和解读,其过程严谨而不失趣味,其结论虽简洁却又发人深省。如在《#9@k牌中的法律故事》之“梅花K的故事:刑事司法改革中的‘所罗门王结’”中,作者写道:春节,家中来了几位客人,闲来无事打牌。论及#9@k牌的起源,我说#9@k牌来自欧洲,每张王牌(King)都有其法律渊源。关于梅花K,相传弗尼吉亚的戈迪亚斯王系了一个复杂的绳结,并宣告谁能解开它,谁就会成为亚细亚王,但数百年都未曾

有人解开。马其顿亚历山大大帝拔出剑来,一剑把绳结劈成了两半,这个保留了数百载的难解之结,就这样轻易地被解开了。亚历山大大帝最终成为亚细亚王,因为他参悟了“所罗门王结”中的智慧:王者,之所以成王,在于大刀阔斧的改革以及当断即断的勇气。

作者试图用#9@k牌的故事说明,目前我国的刑事诉讼制度与社会的发展一样处于转型期,我们在制度改革方面也应有亚历山大大帝那样的智慧与勇气,既要大刀阔斧又要设计周密,不能在核心问题上过于谨小慎微而错过了改革的最佳时机,这样才能使刑事诉讼制度趋于完善。

书中作者通过鲜活的故事,解构了深奥的程序法理,反映了作者扎实的专业功底及超强的文字驾驭能力。除了这些轻松而又富含法理的文章之外,作者在“治学人生”这一辑中向我们讲述他求学的艰辛与不易。我从来都坚信,每一个成功者的背后都有一个难以为外人言道的故事,每一个头顶光环的人也必定经历了常人没有经历过的苦痛与辛酸,施鹏鹏教授便是一个绝佳的例证:29岁被评为法学教授,当时是国内最年轻的法学教授;掌握5门外国语言;拿到国内外两所名校的博士学位;获法国外交部“艾菲尔奖学金”?? 光环背后必定是常人难以想象的付出,他在法国埃克斯所租的房子近20平方米,不到一年内便全部被用奖学金购买的资料所堆满。20xx年,西南政法大学几位教授到法国马

赛三大进行学术访问,施鹏鹏邀请他们在住所吃火锅。一位教授戏言,无须板凳,直接坐在书上即可。回国时打包行李,他所带回的仅法文资料就整理了满满的几十箱,重量接近一吨,光书籍的邮寄费就花了一万多元。

对于一个学者的研究而言,收集资料只是最基础的工作,只是万里长征的第一步,而对资料的阅读、消化和吸收更是漫长而枯燥的过程。“从20xx年高强度阅读开始,我的作息时间便开始完全昼夜颠倒,但毕竟乱中有序:每天凌晨三四点睡,十点半起,午饭后再休息一个小时。而20xx年则进入更高强度的写作期,作息时间完全混乱不堪,累了就睡,醒了就写,经常不知道白天黑夜。”看完这段对于近乎疯狂学习和写作状态的描述,让我感慨不已:最年轻的法学教授原来是这样炼成的。

在阅读这本书的时候,我留心到作者数次引用了《阿甘正传》里的一句话“我总是向目标奔跑着,但从未想过,跑可以给我带来什么”(Now, it used to be, I ran to get where I was goin'. I never thought it would take me anywhere),我觉得这句话就相当于他的座右铭,也是他的真实写照:他对于人生和学问也是如此,总是向着目标奔跑,但从未想过跑可以给他带来什么。

总的看来这部《十字架上的正义》史论结合、述论结合,深刻地揭示出了司法文明的丰富底蕴与要素。

The consideration about<<Seeking justice>>

Seeking justice,formerly known as The Hungry Rabbit Jumps,is a 2011 action film starring Nicolas Cage,Guy Peace and January Jones. Seeking justice mainly tell us a story about: A happy married family man's quiet life is turned upside-down when his wife is brutally attacted one night while leaving .His husband unwittingly pulls himself into a dangerous underground vililante operation after agreeing to an intriguing offer for a stranger to exact vengeance on is wife's attacter . While continuing to protect his wife from the truth, he quickly discovers that his quest for justice could lead to frightening and deadly consequences .

After I watched the movie ,I can't come down for a long time. On the one hand ,it's due to the thriller and visually simulating of the movie itself,on the other hand ,of course , the principal aspect,the story that the movie present to us could cause one to think deeply about .

I can't find a suitable definition to desicrib the emotion of male title role,maybe wo could say wood.While we were hurted ,we may want to hurt opponent in the same way even in a worse way ,even for this reason to hate a crowed of people. What's worse that we even think that we are right and we are just. When we get's to this point, many people may recalla well-known saying of Buddhism“When the cycle of reprisal and retaliation could come to an end “,but none of us

have the standpiont to say it .There're so many aspects are objective,physical,and can be quanlitified in the world ,but it's only feeling that couldn‘t be quanlitified. The myriads of changes of our expierences make us can't keep objective absolutely, thus we can't remand others to tolerate.

What I want discuss is to make the "justice "pump,minification and specific。The desire of justice is a kind of preserve of justice . The desire is common and sound ,no matter if it's not just. The criteria that I could recognize now about justice ,kind ,are all depend on whether it will not hurt others' .

In order not te be killed by others ,therefor he have to be the killer .because there's only the heart made by human flesh in front of the injured malice .This is a kind of helpless which is purely and weakness.And someone comes to have malice in helpless and sorrow.When many people assume axiom as truth,assume practice as justice ,eventually ,there're many people come to the seamy side of mind im the world .
