使 用 说 明

一、双方在签订本合同前,应认真阅读本合同。本合同一经签订,即具有法律效力,双方必须严格履行。

二、本合同必须由用人单位(甲方)的法定代表人(或者委托代理人)和职工(乙方)签字或盖章,并加盖用人单位公章(或者劳动合同专用章)。

三、本合同中的空栏,由双方协商确定后填写,并不得违反法律、法规和相关规定;不需填写的空栏,划上“/”。

四、工时制度分为标准工时、不定时、综合计算工时三种。实行不定时、综合计算工时工作制的,应经劳动保障部门批准。

五、本合同的未尽事宜,可另行签订补充协议,作为本合同的附件,与本合同一并履行。

六、本合同必须认真填写,字迹清楚、文字简练、准确,并不得擅自涂改。

根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》和国家及省的有关规定,甲乙双方按照合法、公平、平等自愿、协商一致、诚实信用的原则订立本合同。

一、劳动合同期限

(一)合同期

双方同意按以下第种方式确定本合同期限:

1.固定期限:从年月日起至年月日止。2.无固定期限:从/年/月/日起至法定终止条件出现时止。

3.以完成一定工作任务为期限:从/起至 /工作任务完成时止。该工作任务完成的标志为/。

(二)试用期

二、工作内容和工作地点

三、工作时间和休息休假

(一)甲、乙双方同意按以下第 1 种方式确定乙方的工作时间:

1.标准工时工作制,即每日工作8小时,每周工作5天,每周至少休息一天。

2.不定时工作制,乙方所在岗位实行不定时工作制。

3.综合计算工时工作制,乙方所在岗位实行以 / 为周期,总工时小时的综合计算工时工作制。

(二)甲方因工作需要,经与乙方协商后可以延长工作时间。

(三)本行业带有特殊性,淡旺季较为明显,公司依法制定符合本行业的工作时间与休息休假制度。

四、劳动报酬

(一)乙方正常工作时间的工资按下列第 1 种形式执行,并不得低于当地最低工资标准。

1.计时工资:

(1)乙方正常工作时间的工资为 1510 元/月;

(2)乙方正常工作时间试用期工资为 1510 元/月。

(二)乙方的绩效薪酬或奖金的计发办法为:详见薪酬管理制度 。

(三)乙方的津贴、补贴的发放标准和办法为:详见薪酬管理制度 。

(四)甲方每月 15 日发放 上月 (当月/上月)工资。如遇法定休假日或休息日,则提前到最近的工作日支付。

(五)甲方依法安排乙方在休息日、法定休假日加班的,将安排乙方补休。

五、劳动保护、劳动条件和职业危害防护

(一)甲方按国家和省有关劳动保护规定提供符合国家劳动卫生标准的劳动作业场所,切实保护乙方在生产工作中的安全和健康。

(二)甲方根据乙方从事的工作岗位,按国家有关规定,发给乙方必要的劳动保护用品。

(三)乙方患职业病、因工负伤或者因工死亡的,甲方应按《工伤保险条例》的规定办理。

六、合同的变更

(一)任何一方要求变更本合同的有关内容,都应以书面形式通知对方。

(二)甲乙双方经协商一致,可以变更本合同,并办理书面变更手续。变更后的劳动合同文本由甲乙双方各执一份。

七、合同的解除和终止

(一)甲乙双方解除、终止劳动合同应当依照《劳动合同法》有关规定执行。

(二)甲方应当在解除或者终止本合同时出具解除或者终止劳动合同的证明。

(三)本合同期满或法定终止条件出现,本合同即行终止。

(四)乙方解除本合同,应当提前三十日以书面形式通知甲方;在试用期内的提前三日通知甲方。

八、调解与仲裁

双方履行本合同如发生争议,可先协商解决;不愿协商或协商不成的,可以向甲方劳动争议调解机构申请调解;调解无效的,可在法定仲裁时效内向有管辖权的劳动争议仲裁委员会申请仲裁;也可以直接向劳动争议仲裁委员会申请仲裁。对仲裁裁决不服的,可在法定期限内向人民法院提起诉讼。

九、服务期与竞业限制

(一)甲乙双方可就服务期和竞业限制依法签订专门的协议。

(二)甲乙双方签订培训协议的,且协议中有约定服务期的,乙方应等服务期满后才可离职,并作为本合同的附件。

十、其他

(一)本合同未尽事宜,按国家和地方有关政策规定办理。在合同期内,如本合同条款与国家、省有关劳动管理新规定相抵触的,按新规定执行。

(二)下列文件规定为本合同附件,与本合同具有同等效力:

1、公司《员工手册》、规章制度与本合同具有同等效力。

2、《培训协议》、《保密协议》、与本合同具有同等效力 。

This Contract is concluded on the basis of principles of lawfulness, fairness, equality, free will, negotiated consensus and good faith by and between the foresaid Employer and Employee in accordance with the Labor Law of the People's Republic of China (the PRC Labor Law), the Law of the People’s Republic of China on Employment Contracts (the PRC Employment Contract Law) and other relevant laws and regulations of China and of Guangdong Province.

C. Working Hours and Rest and Leave

(A)The Parties agree to determine the working hour pursuant to mode below:

2.Non-schedule working hour system. The position of the Employee practices non-schedule working hour system after the approval of the labor administration authority.
