海事报告规则

第 1 条

本规则所称海事,指船舶沉没、搁浅、碰撞、强制停泊或其他意外事故及有关于船舶、货载、船员或旅客之非常事变。

第 2 条

本规则所称船舶,依海商法之规定。但不适用海商法之船舶,除军事建制之舰艇外,得比照本规则之规定办理之。

第 3 条

船长遇船舶发生海事时,应依海商法第四十九条之规定,作成海事报告。

前项海事报告之作成,于船长遭难死亡或失踪时,由生还船员中职务最高者为之,全船遭难死亡或失踪时,由船舶所有人或船舶代理人为之。

海事报告应有海员或旅客之证明。但其报告系船长于遭难后,独身脱险之处作成者,不在此限。

第 4 条

海事报告应载明左列事项:

一制作海事报告年、月、日。

二船名。

三国籍及船籍港。

四船舶所有人。

五船舶营运人。

六建造完成之年、月、日。

七上次检修日期。

八总吨位及净吨位。

九主机种类、数目及推进动力。

十驾驶操纵系统。

十一观测设备。

十二求救信号设备。

十三载客人数及载货数量。

十四船艏艉吃水。

十五海事概述。

十六海事发生地点。

十七海事发生时间。

十八天候、海象及潮流。

十九船长姓名及执业证书。

二十轮机长姓名及执业证书。

二十一当值驾驶员、轮机员姓名及执业证书。

二十二引水人姓名。

二十三海事经过及处理。

二十四船长签章。

二十五有关海员及旅客签章。

船长应照航政机关印置备用之空白海事报告书制作海事报告。但海事报告在国外制作时,不在此限。

海事报告书格式,另定之。

海事报告规则

第 5 条

海事报告之送请签证,依左列规定:

一船舶在港内发生海事者:

(一) 在国内送该港口之航政机关。

(二) 在国外送驻在该港口或其附近之中华民国使领馆或具同等权责机构,当地航政机关或法院认可之公证人。

二船舶在执行中发生海事者:

(一) 在国内送该船舶或船长最先到达港口之航政机关。

(二) 在国外送该船舶或船长最先到达港之驻在该港口或其附近之中华民

国使领馆或具同等权责机构,当地航政机关或法院认可之公证人。

船舶或船长到达前项第二款规定之最先港口,如因实际困难,不克签证时,得说明理由,于到达其次港口时,送请签证之。

第 6 条

海事报告每次签证一式五份。由航政机关签证者,留存三份,发还二份,由其他机关签证者,留存一份,发还四份。

海事报告由国内非船籍港之航政机关签证,其情节重大或有关者,该航政机关应将留存之三份中,以一份寄送船籍港航政机关。

海事报告由国外有关权责签证者。船长应将签证之海事报告二份,于签证后三日内,寄送船籍港航政机关。

第 7 条

外国籍船舶依外国船舶运送业雇用中华民国船员办法雇用我国船长、海员者,其海事报告之签证依第五条之规定。

第 8 条

海事报告在国内港口之航政机关签证者。该航政机关应针对该海事案件之实际情形予以调查评议,为适当之处理。

海事报告在国外港口之机关签证者,其海事案件之调查评议由该船舶船籍港之航政机关办理,

但为船舶所有人或其代理及船长、海员之便利,得由其住、居所最近之航政机关办理之。

第 9 条

海事报告送请签证时,航政机关或有关权责机关除当时确知所报告之海事并未发生者外,应即予以签证。

海事报告之签证,仅系证明船长已作成海事报告及将海事报告送请签证之时间。但海事报告之内容及海事责任之认定,均不在签证所证明范围之内。

航政机关或有关权责机关签证海事报告,应俟船长亲自到场当面签字。但经核对海事报告、船海日志及护照上之船长签字,认为得予签证者,不在此限。

第 10 条

海事报告之送请签证,应于海事发生之后,或该船舶或船长到达第五条规定之港口后七日内为之。

第 11 条

海事报告于国内签证时,一式五份每次应缴纳签证费如左,每增加一份应增缴百分之十之费用:

一渔船、小船:新台币贰佰元。

二国轮:新台币肆佰元。

三外轮:新台币壹仟元。

海事报告于国外签证时,签证费依签证机关之规定。

第 12 条

本规则自发布日施行。
