8 LAYTIME : NOR TO BE TENDER UPON VSLS ARRIVAL AT L/D PORT,LAYTIME TO

COMMENCE W/I 12RUNNING HOURS AFTER TENDERING OF NOTICE OF READINESS UNLESS LOADING/DISCHARGING IS SOONER COMMENCED. IN WHICH CASE ACTUAL TIME USED SHALL BE COUNTED AS LAYTIME.

装卸起算时间:船舶抵装/卸港,递交船舶准备就绪通知书12小时后起算装卸时间, 或者以实际装卸时货开始时间起算,以早者为准.

9 FREIGHT : USD PMT FIOST BSS 1/1

运费:运费是美圆 元每吨, 一装一卸,船东不负责装/卸费用及平舱,理舱费用。.

10 DEM/DES:USD11000 PD PR/DHD WTS AT BENDS. IN CASE CGO DOCUS NOT BE OF READINESS WHEN VSL ARRIVAL AT BENDS, DES /DEM IF ANY TO BE SETTLED WITHIN 10 DAYS AFTER COMPLETION OF DISCHARGING.

滞期速遣费:滞期费11000美金每天,速谴费是滞期费的一半。

船舶抵达装/卸港后,速谴费/滞期需在航次结束后10天内结清.

11 PAYMENT: FULL FREIGHT 20 PCT TO BE PAID TO OWNERS NOMINATED BANK ACCOUNT WITHIN 5(Five) BANKING DAYS AFTER COMPLETION OF LOADING.

运费支付:20%运费必须在船舶装船完毕后5个银行工作日内将运费付到船东指定账上。

BALANCE 80% WILL BE PAID WITHIN 10 DAYS AFTER COMPLETION OF DISCHARGING, OWNER SIGNING AND RELEASING O.B/L AGAINST CHTR’S FRT REMITTING BANK SLIP.

在卸货完毕的14天之内支付余下的80%,船东凭租家运费支付银行水单签放提单.

12 FREIGHT IS DEEMED TO BE EARNED ON COMPLETION OF LOADING AND SHALL BE DISCOUNTLESS AND NON-RETURNABLE WHETHER SHIP AND/OR CARGO LOST OR NOT.

运费视作装船结束后即已赚取,无论船舶灭失与否,不得抵扣,不得返回。

13 OWS TO GUARANTEE VSLS GEAR, GRABS ARE IN GOOD WORKING CONDITIONS AS PER MENTIONED ON THE PARTICULARS OF VSLS. IF VSL'S CRANE/GRABS IS OUT OF ORDER THEN TIME NOT TO BE COUNTED AS LAYTIME PER CRANES PRORATA.

船东保证船吊及抓斗处于船舶规范规定描述的良好的的工作状态.如果船吊及抓斗不能正常工作,按比例扣减装卸时间。

14 OWS AGENT BENDS.

装卸港代理船东指定。

15. N.O.R. TO BE TENDERED UPON VSLS ARRIVAL AT BOTH ENDS, WHETHER IN BERTH OR NOT, WHETHER IN PORT OR NOT, WHETHER FREE PRATIQUE OR NOT, WHETHER CUSTOM CLEARANCE OR NOT.

在船舶到达装卸港时,无论在是否靠泊,无论是否在港,无论是否清关,无论是否入港许可,准

备就绪通知书在抵港后递交,不受任何时间限制.

16 CONGEN BS/L TO BE USED, CARGO QTY ON BS/L TO BE DETERMINED BY SHIPPERS DRAFT SURVEY JOINTLY WITH MASTER AT LOADING PORT.

使用金康提单,提单上的货物数量按照发货人及船长的联合水尺检验确定。

如果有船舶超龄保险,船东支付。

18 OWS / MASTER WILL GIVE ETA NOTICE5/3/2/1 AND 6 HRS BOTH ENDS.

船东或船长必须给予船舶预计抵达的5/3/2/1天及6小时的到港通知。

19.AS CARGO ON FREE IN/OUT STOWED/TRIMMED BASIS, OWS TO HOLD

2 17 OVERAGE PREMIUM FOR OWNERS ACCT.

CHTRS/SHIPPERS/RCVRS/STEVEDORES RESPONSIBLE FOR STEVEDORES DAMAGE TO SHIP.

由于船东不负责装货、卸货、平舱、理舱,船东有权要求租家、发货人、收货人、装卸公司对装卸过程对船舶损害负责。

20 CHTRS WILL TAKE SPECIAL CARE TO ENSURE NO DAMAGE OCCURS DURING OPERATION.

在作业过程中租家必须采取足够的措施避免损害船舶。

21. LIGHTERAGE/LIGHTERING/SHORE CRANE/FLOATING CRANE/SHIFTING, IF ANY, SHALL BE FOR OWNERS’ TIME AND ACCOUNT AT BENDS.

如果在装卸港需要安排驳船/过驳/岸吊/浮吊/移泊,由船东承担时间和费用

22. TAXES / DUES ON CARGO TO BE FOR CHTRS ACCT.

因货物发生的税收/税赋由租家支付。

23. TAXES / DUES ON VSL / FREIGHT TO BE FOR OWNERS ACCT.

因船舶或运费发生的税收/税赋由船东支付。

24. IF THE ORIGINAL BS/L IS NOT AVAILABLE AT DISPORT THE OWS SHUD DISCHARGING THE CGO AGAINST CHTRS SINGLE LOI ACCORDING TO ONWER P &I WORDING N COPY BS/L.DELY THE CARGO BSS ORIG BS/L ONLY.船东凭正本提单放货,如正本提单无法在船舶抵卸港前到达目的港,租家可凭提单副本及船东保险公司提供的保函卸货,放货要凭正本提单。

25. OWS CONFIRM THAT VSL HAS BEEN COVERED UNDER P&I CLUB AND HAVING VALID SHIPPING CERTIFICATES.

船东保证船舶加入了船东互保协会,拥有合法的航行证书。

26. ANY DISPUTES ARISING UNDER THIS CHARTER PARTY ARE TO BE REFRRED TO ARBITRATION TO INTERNATIONAL ECONOMIC AND TRADE ARBITRATION COMMISSION OF CHINA IN SHANGHAI ACCORDING TO CHINA’S LAWS AND INTERNATIONAL PRACTICES WHEN APPLYING ITS RULES OF PROCEDURE.

该租约下发生的任何纠纷提交中国国际经济贸易仲裁委员会,适用按照其规定的仲裁程序运用中国法律和国际惯例在上海进行仲裁。

其它未尽事宜根据金康合同19xx年版。

28. ENGLISH/CHINESE IS IN SAME FORCE OF LAW CONFLICTS BETWEEN THERE TWO

LANGUAGES ARISING THEREFROM,IF ANY,SHALL BE SUBJECT TO CHINESE VERSION. 中英文具有相同的法律效力,如文字解释有异议,以中文为准.
